5 Order issued in cases of 3 persons missing for five years

ISLAMABAD: The Islamabad High Court (IHC) has issued a major order in the appeals of cases of IT engineer Sajid Mahmood and two other missing persons who have been missing for five years.

Justice Amir Farooq and Justice Mian Gul Hassan Aurangzeb heard the appeals of the federation.

The court summoned the names of Secretary Defense, IG Islamabad, Chief Commissioners and Deputy Commissioners from the time of their disappearance till date.

The Islamabad High Court also sought the names of the SHOs of the respective areas of the three missing persons and directed the Additional Attorney General to provide a list of all the officers.

The court sought the names of the officers concerned for failing to recover the missing persons.

Lawyer Omar Ijaz Gilani and other lawyers appeared before the court on behalf of petitioner Maira Sajid.

The Additional Attorney General said that the record of the attempt to find these persons will be given at the next hearing.

The court remarked that if a person goes missing, then the responsibility lies with the state and not with the state. Since the appeal is pending, the government has not made any serious effort or action.

The court said that the Attorney General had come to ask for stay but did not try to recover the missing Sajid Mahmood and others.

The court adjourned further hearing of the case for two weeks.

Petitioner Maira Sajid had filed a petition in 2016 for the recovery of her husband Sajid Mahmood.
