Panel of Independent Experts for the election of Magistrates to the Constitutional Court request greater dissemination in the stages of the election process

The International Panel of Experts and Independent Experts for the election of magistrates to the Constitutional Court (TC), issued its first statement in which they point out that, although the transparency standards were improved with respect to previous processes, they regret that it has not been hung opportunely deny resolutions of strikeouts and minutes on the website of the Special Commission that selects the candidates for the TC.

Therefore, they recommend correcting these omissions “in order to maintain an adequate standard of transparency, due process and access to information.”

They maintain that the legal concept of “solvency and moral suitability”, a requirement to be elected as a member of the highest interpretive body of the Magna Carta, lacks precision, for which reason they urge this special commission to specify, in accordance with universally accepted standards, this term, taking into account that it will be valued in the successive stages of the contest.

LEE | “This process is showing that there is no evidence linking Guillermo Bermejo with the Quispe Palomino or the Vraem terrorists,” says his lawyer, Ronald Atencio

In addition, they requested that the necessary measures be taken to overcome the structural barriers that affect women in the selection processes for this autonomous body and added that the implementation of additional mechanisms for citizen participation does not affect the autonomy of Congress, an entity that must appoint the magistrates who will make up the plenary session of the TC. Consequently, the implementation of participation mechanisms in addition to the interposition of strikeouts was recommended, in order to involve the citizenry.

The panel stressed that, given the importance of this election, it is of the utmost importance to promote maximum dissemination of all stages of the process, which requires the collaboration of all State agencies, including Parliament.
