The decision on a preliminary measure against the publication of reports was canceled by the Supreme Court

The Supreme Court says that a preliminary injunction against material published before a charge is proved, i.e. before a trial has even started, is tantamount to the death penalty. The court said that issues such as freedom of expression and limitation of public debate, as well as the possibility of courts resorting to protracted litigation, should be kept in mind when issuing an injunction in a defamation case. It is to be noted that the Supreme Court was hearing Bloomberg’s petition against the March 14 order of the Delhi High Court. The Supreme Court rejected Bloomberg’s appeal against the decision of the first instance court.
